The Patent Research Exception

The Gowers Review of Intellectual Property made a number of recommendations to Government to improve the functioning of the intellectual property system. This consultation follows from Recommendation 1 which is to clarify the patent research exception as allowed under Section 60(5) of the Patent Act 1977. The purpose of this consultation is to seek evidence on the effect of the research exception and where we identify stakeholder concerns we will seek the most practicable solution to resolve them. A formal consultation will then follow if needed.

In order to keep the consultation document succinct and straightforward we have kept examples of case law and legislation (both in the UK and abroad) to a minimum. However, for interested parties an exploration of domestic and international law is available in PDF PDF document(32Kb) and Word MS Word Document(62Kb) format.
